TERMS OF USE
Welcome to Clutter! These Terms of Use (“Terms”) of Clutter Inc. and Clutter RE LLC (together, “Clutter,” “we,” or “us”) are an agreement that describes your rights and responsibilities as a Clutter User. This page explains the terms by which you may access or use our online and/or mobile services, web sites, applications, software, and documentation provided on or in connection with clutter.com (collectively the “Site”), including our smart storage, moving, and related services.
By accessing or using the Site and/or using the Services, you signify that you have read, understood, and agree to be bound by these Terms. These Terms apply to all visitors, users, and others who register for or otherwise access the Site or use the Services.
01. USE OF OUR SITE
Eligibility
You must be at least 18 years old to use the Site and Services. Any use or access of the Site or Services by anyone under 18 is strictly prohibited.Clutter Site
You are granted a non-exclusive, limited, non-transferable, freely revocable license to use the Site for your personal, noncommercial use only. Clutter may terminate this license at any time.Clutter Accounts
Your Clutter Account gives you access to the Services and other functionality. You may never use another User’s Clutter Account without permission.Site Rules
You agree not to engage in prohibited activities, including but not limited to copying, distributing, or transmitting any part of the Site, using automated systems to access the Site, and transmitting spam.Changes to the Site or Services
Clutter may change the Site or Services, stop providing them, or create usage limits without prior notice.Disputes with Other Users
You are solely responsible for your interactions with other Users.
02. THE CLUTTER SERVICES
Services Overview
Clutter provides moving and smart storage services, including transporting and storing Customer Items.Customer Items
Customer Items are the items linked to your account. Clutter does not assume liability for stolen or missing Customer Items after pickup or drop-off.Responsibilities
You are responsible for providing accurate information to Clutter, verifying the inventory of stored items, and ensuring access to your property for Services.Prohibited Customer Items
You must not provide Clutter with illegal items or items that pose a risk.
05. PAYMENT AND CANCELLATION
By using the Services, you agree to Clutter’s pricing and payment terms. Subscription Services may require recurring payments, and you can cancel anytime after the minimum term.
06. CLUTTER’S LIMITED SECURITY WARRANTY
Clutter provides a limited security warranty regarding your Customer Items as per the Limited Security Warranty Policy.
08. PRIVACY
You consent to the collection, use, and disclosure of your personally identifiable information as set forth in our Privacy Policy.
10. INDEMNITY
You agree to indemnify Clutter against any claims arising out of your use of the Site and Services.
11. NO WARRANTY
The Site and Services are provided on an “AS IS” basis. Clutter does not warrant the accuracy or availability of the Site or Services.
12. LIMITATION OF LIABILITY
Clutter shall not be liable for indirect or consequential damages arising from your use of the Site or Services.
15. YOUR ACCEPTANCE OF THESE TERMS
You certify that you have read and agree to these Terms, acknowledging that they limit your legal rights.
16. GOVERNING LAW
These Terms shall be governed by the laws of the State of California. Any disputes shall be resolved first through informal negotiation, and then if unresolved, binding arbitration.
